1. Agreement to Terms

By accessing or using Property Prospect ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

Property Prospect LLC ("we," "us," or "our") operates the Property Prospect platform, which provides property data, owner insights, mapping, and CRM tools for real estate professionals.

2. Description of Service

Property Prospect is a software-as-a-service platform that provides:

Property data lookup and owner information
Map-based lead generation tools
CRM and deal tracking functionality
Access to third-party property data providers

The Service operates on a credits-based usage model, where different actions consume different types of credits (Search Credits, Phone Credits, Mail Credits).

3. User Accounts

To access certain features of the Service, you must create an account. You are responsible for:

Maintaining the confidentiality of your account credentials
All activities that occur under your account
Ensuring your account information is accurate and up-to-date
Notifying us immediately of any unauthorized use of your account

4. Credits and Usage

Property Prospect uses a credits-based system:

Search Credits are consumed when performing property lookups
Phone Credits are consumed when accessing phone number data
Mail Credits are consumed when accessing mailing address data
Credits are non-refundable and expire according to the terms of your subscription
You may not transfer credits to another account

We reserve the right to modify credit costs, credit expiration policies, and credit allocation at any time with reasonable notice.

5. Data Accuracy and Third-Party Providers

Property Prospect aggregates data from multiple third-party data providers, including but not limited to ATTOM Data Solutions and other property data services.

We do not guarantee the accuracy, completeness, or timeliness of any data provided through the Service. Property data, owner information, and other details are provided "as-is" based on information from third-party sources.

You acknowledge that:

Property data may be outdated, incomplete, or inaccurate
Owner information may not reflect current ownership
Property values and assessments are estimates and may not reflect actual market value
You should verify all information independently before making business decisions

6. Acceptable Use

You agree not to:

Use the Service for any illegal or unauthorized purpose
Violate any laws in your jurisdiction while using the Service
Attempt to gain unauthorized access to the Service or related systems
Interfere with or disrupt the Service or servers connected to the Service
Scrape, crawl, or systematically extract data from the Service
Resell or redistribute data obtained through the Service without authorization
Use automated systems to access the Service in a manner that exceeds reasonable usage

7. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Property Prospect LLC and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROPERTY PROSPECT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SERVICE.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

You acknowledge that you use the Service and any data obtained through it at your own risk. We are not responsible for any business decisions, investments, or actions you take based on information from the Service.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

10. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

11. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the Service after any changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the appropriate courts of the United States.
